1. Who we are

Farm Pro (“the Service”) is operated by Don Martin & sons Inc., trading as Farm Pro (“we”, “us”). By using the Service you are entering into an agreement with Don Martin & sons Inc..

2. Acceptance

By creating an account or continuing to use the Service you agree to these terms. If you do not agree, do not use the Service.

3. Product description

Farm Pro is an agricultural mapping and job-tracking tool for drawing spray and manure application areas, calculating acreage, and organizing jobs, customers, farms, and product records.

4. Account and credentials

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose or in violation of any regulation;
  • attempt fraud, spam, or abuse of trial or refund features;
  • infringe intellectual property or privacy rights of others;
  • interfere with the security or integrity of the Service (including probing, scraping, or introducing malware).

6. Intellectual property

We retain all rights, title, and interest in the Service, including software, documentation, and branding. You are granted a limited, non-exclusive, non-transferable right to use the Service within your subscription plan.

7. Service level

The Service is provided on an “as is” basis. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Agronomic disclaimer

Any product label information, application rates, mix ratios, or restriction data displayed by the Service is for reference only and may be incomplete or out of date. You are solely responsible for reading the current registered product label and following all legal, safety, and application requirements. The Service does not provide agronomic, legal, or professional advice.

9. Payments, subscriptions, and refunds

Payments and billing (including tax calculation, invoicing, and cancellations) are handled by our reseller, Paddle. For payment and subscription mechanics please refer to the Paddle Buyer Terms. See our Refund Policy for refund terms.

10. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, we may delete your account data after a reasonable export window.

12. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these terms excludes liability that cannot be excluded by law.

13. Governing law

These terms are governed by the laws of the State of Iowa, United States, without regard to conflict-of-law rules. The state and federal courts located in Iowa have exclusive jurisdiction over any dispute arising from these terms.
